Countries consider time out on the 'leap second'

GENEVA (AP) ? It's high noon for the humble leap second.

After ten years of talks, governments are headed for a showdown vote this week on an issue that pits technological precision against nature's whims.

The United States, France and others are pushing for countries at a U.N. telecom meeting to abolish the leap second, which for 40 years has kept computers in sync with the Earth day.

Leap seconds are necessary to prevent atomic clocks from speeding ahead of solar time. They are added at irregular intervals, effectively stretching atomic time by a heartbeat to make up for the irregular wobble in the Earth's rotation.

Critics warn that scrapping the leap second would break the last link between the passing of time and the course of the sun across the sky. But backers say machines shouldn't any longer be tethered to the imprecise cycle of sunrise and sunset.

"This would be an important decision because the problem of introducing the leap second would disappear and we would have a more steady time than we have today," Vincent Meens, an official at the International Telecommunication Union who has chaired technical talks on the issue, said Tuesday.

Operators of cell phone networks, financial markets and air traffic control systems could then rely on the near-absolute precision offered by atomic clocks without having to worry about stopping their systems for the length of a heartbeat every year or two.

"Most of the people who operate time services favor discontinuing leap seconds," said Judah Levine, a physicist at the National Institute of Standards and Technology in Boulder, Colorado.

"The main problem is that the leap second is usually implemented by stopping the clock for one second. However, the world doesn't stop," he said.

Satellite navigation systems like GPS don't use leap seconds, which adds confusion, said Levine. "In addition, the leap second occurs in the middle of the day in Asia and Australia, which is particularly inconvenient."

In a world increasingly reliant on computers for mission-critical measurements, any glitch could be costly as well as fatal, said Elisa Felicitas Arias, director of the time department at the Paris-based International Bureau of Weights and Measures.

"You can make a dramatic error if, for example, you are trying to land an aircraft," she said, noting that rocket launches, too, are never scheduled on days when a leap second might occur. "This is something we are trying to correct."

Critics say the risks are overblown and leap seconds have been used successfully since 1972, despite being hard to predict more than six months in advance.

China has warned that any change could hurt astronomers, who need to be able to compare observations spanning thousands of years as part of their work.

Canada, too, has raised objections to the proposed plan, while Britain has warned that it could spell the end of Greenwich Mean Time, or GMT, as a meaningful measure.

"Leap seconds are an inconvenience to the telecommunications people, but there are many other users of time who should be considered," said Ken Seidelmann, a research professor at the University of Virginia in Charlottesville and former director of astrometry at the U.S. Naval Observatory.

Killing off the leap second would also result in atomic clocks slowly outrunning the solar day by a rate of about 90 seconds a century. After many thousands of years, atomic clocks would say it's midday when outside the sun has yet to rise.

"This is replacing a small problem with a big problem further down the line," said Daniel Gambis, an astronomer at the Paris Observatory and the man who alerted timekeepers around the world to the next leap second, due on June 30.

Arias said solutions could be found for such problems, but conceded that severing the link between the proposed new standard time ? as measured by atomic clocks ? and the solar time people are accustomed to might seem troubling to many.

Still, the time for change has come, she argued.

Unless a last minute consensus is reached, delegates at the ITU meeting in Geneva are expected to vote on the issue Thursday or Friday.

Indianapolis looks to future after firing Caldwell (AP)

INDIANAPOLIS ? Jim Irsay has big plans for the Colts' future. He just hasn't worked through the details yet.

Two weeks after overhauling the front office, Indianapolis took the next big step in its major housecleaning project Tuesday ? firing coach Jim Caldwell after three seasons.

"This (search) is something that's going to start immediately and I really think we're going to get a coach that's going to lead us going into the future, and I think it's a bright future," Irsay said Tuesday. "It's tough to change and go forward, we've had such excellence and greatness here over such a long period of time and that's what I expect us to do again."

Irsay is following the same plan he installed after the 1997 season. Back then, a season-ending loss on the road allowed the 3-13 Colts to clinch the No. 1 overall draft pick. The next day, Irsay fired the general manager and the head coach and eventually changed quarterbacks.

It could happen again with a little more deliberation.

The day after losing at Jacksonville to post their worst record (2-14) in two decades and wrap up this year's No. 1 pick, Irsay fired team vice chairman Bill Polian and his son, Chris, the Colts' general manager. Last week, Irsay hired 39-year-old Ryan Grigson as the replacement for the Polians.

Since then, Grigson and Irsay have been in almost constant meetings debating the future of the coaching staff.

On Monday, Caldwell and former Rams coach Steve Spagnuolo met in Indianapolis about the Colts' defensive coordinator job. Most took it as an indication Caldwell would be retained. That was still the conventional wisdom Tuesday.

Eventually, Irsay and Grigson proved the pundits wrong. Irsay said he told Caldwell of the decision at about 2 p.m., shortly before the team confirmed the firing.

"We've talked about where we want to be more balanced," Irsay said. "We want to be excellent on defense and more consistent, and I think that's something that we're looking at as part of the vision. I don't think the guy has to be offensive or defensive or anything like that. It's a heavy lifting process right now."

It's unclear where the Colts will turn next.

Yes, Grigson acknowledged, he has a short list of candidates. Not surprisingly, he didn't say who was on the list, which could include names such as Packers offensive coordinator Joe Philbin, Eagles offensive coordinator Mary Mornhinweg and perhaps Spagnuolo.

Neither Grigson nor Irsay provided a timeline for the hire.

"We want leadership. Leadership is important," Grigson said after making his first big decision in charge of an NFL team. "We want strong leadership, and we want someone who shares his vision in this new era of Colts football. We want the best man and the best leader and the man that gives us the best way to go."

One thing they did agree on: The future didn't include Caldwell

After winning his first 14 games, an NFL record for a rookie head coach, and becoming only the fifth first-year coach to take his team to the Super Bowl, Caldwell did a masterful job guiding the injury-plagued Colts through a thicket of injuries and back to the playoffs in 2010.

But those successes all came with Peyton Manning, who led the Colts to a league-record 115 regular-season wins in the previous decade and a record-tying nine straight playoff appearances.

This year, with Manning out the entire season, the Colts lost their first 13 games.

Among players and coaches, Caldwell was universally well-liked. The list included Manning, who won all four of his record-setting MVP Awards with Caldwell on Indy's staff, as well as perennial Pro Bowl center Jeff Saturday.

"I think coach Caldwell has done a very good job. He has gotten the most out of his players, and we play hard for him each and every week," Saturday said before the season finale. "We haven't necessarily played well, we've made mistakes and done things, but they have, oftentimes, been things that we've talked about in coaching meetings."

Outsiders often saw it another way.

Fans frequently complained about Caldwell's game management, and some critics referred to Caldwell as a "puppet" of the Polians.

Many never forgave Caldwell for pulling the plug on a perfect season in a Game 15 loss to the Jets in 2009 and pointed to the midseason firing of defensive coordinator Larry Coyer and the long delay in replacing Curtis Painter with Dan Orlvosky at quarterback as decisions that should have come much earlier.

Irsay and Grigson did not characterize Caldwell's 1,099-day tenure the same way as fans.

But with Grigson already searching for a new coach and presumably preparing to take Andrew Luck with the No. 1 pick, the questions now turn to Manning, who had his third neck surgery in 19 months on Sept. 8.

The Colts still are not saying much about Manning's recovery, and Grigson has not yet spoken with Manning, who is owed a $28 million bonus in early March.

"We're not even there with anything regarding Peyton Manning just yet," Grigson said. "We have to know about his medical stuff, first. There's so many things there."

Caldwell ended his Colts' tenure 26-22 overall with one AFC title, two division crowns and one bleak season that has left him unemployed just three years after replacing close friend Tony Dungy, the first black coach to hoist the Lombardi Trophy.

"This was a difficult decision," Irsay said. "I wanted to make sure we took all the time we needed to make sure it was the right decision. ... And just like 14 years, ago, it's a big change for the franchise and at the same time, there's players, coaches, many people on the staff that will go into the new day and get on with the work of 2012."

The microbiome and disease: Gut bacteria influence the severity of heart attacks in rats

New research published online in the FASEB Journal suggests that the types and levels of bacteria in the intestines may be used to predict a person's likelihood of having a heart attack, and that manipulating these organisms may help reduce heart attack risk. This discovery may lead to new diagnostic tests and therapies that physicians use to prevent and treat heart attacks. In addition, this research suggests that probiotics may be able to protect the heart in patients undergoing heart surgery and angioplasty.

"Our discovery is a revolutionary milestone in the prevention and treatment of heart attacks," said John E. Baker, Ph.D., study author from the Division of Cardiothoracic Surgery at the Medical College of Wisconsin in Milwaukee. "The biochemical link between intestinal bacteria, their metabolites, and injury to the heart will reduce the risk of death from a heart attack and, coupled with the use of probiotics, will ultimately be able to improve the overall cardiovascular health of the human population."

To make this discovery, Baker and colleagues conducted experiments involving three groups of rats. The first group was fed a standard diet. The second group was treated orally with the antibiotic vancomycin in the drinking water. The third group was fed a probiotic supplement that contains Lactobacillus plantarum, a bacterium that suppresses the production of leptin.

The group treated with the antibiotic had decreased levels of leptin (a protein hormone that plays a key role in appetite and metabolism), which resulted in smaller heart attacks, and improved recovery of mechanical function as compared to the group fed a standard diet. The antibiotic reduced total bacterial numbers in the intestines and altered the abundance of specific types of bacteria and fungi that live in the gut. Treating these rats with leptin was shown to offset the protection produced by the antibiotic treatment. The third group was fed a probiotic that also altered the numbers and types of bacteria and fungi living in the gut. Like those fed the antibiotic, these rats also had decreased leptin levels, resulting in smaller heart attacks and greater recovery of mechanical function as compared to the first group. Treating these rats with leptin also was shown to offset the protection produced by the probiotic.

"We may not be ready to prescribe yogurt to prevent heart attacks, but this research does gives us a much better understanding of how the microbiome affects our response to injury," said Gerald Weissmann, M.D., Editor-in-Chief of the FASEB Journal. "Just as physicians use cholesterol levels, blood pressure, and overall body composition as measures of heart disease risk, we may soon evaluate our body's susceptibility to disease by looking at the microbes that inhabit the gut."

AMC Expands Walking Dead's Season 3, Announces Return Dates for Mad Men, The Killing (omg!)

AMC has expanded the upcoming third season of The Walking Dead, the network announced Saturday.

The cable channel has ordered 16 new episodes for Season 3, up from the six in Season 1 and 13 in Season 2. The hit zombie drama is currently in the middle of its second season, which returns on Sunday, Feb. 12 at 9/8c.

Jon Hamm announces Mad Men Season 5 premiere date

AMC also announced premiere dates for the highly anticipated returns of Mad Men and The Killing. Mad Men, as series star Jon Hamm leaked earlier this month, will return on Sunday, March 25 at 9/8c with a two-hour Season 5 premiere. The Killing will also kick off its new season with a two-hour premiere, on Sunday, April 1 at 8/7c. (Coincidence that it returns on April Fool's Day? Discuss.) The murder-mystery drama moves to its regular timeslot, 9/8c, the following week.

Gene Hackman Hit By Car, Airlifted to Hospital


Oscar winner Gene Hackman airlifted to the hospital Friday afternoon after he was hit by a car while riding his bike in the Florida Keys, his rep said.

Fortunately, the 81-year-old is alright and and on the mend.

"Gene was airlifted (because he is on an island) to the hospital for routine tests," the rep confirmed. "Everything is fine and Gene is on his way home now."

The actor suffered only "a few bumps and bruises."

TMZ, which first reported the accident, said that the collision occurred at around 3 p.m. EST Friday, and the Florida Highway Patrol is investigating the incident.

Gene was assigned a special hospital room for important patients where doctors could keep a close eye on the star, who suffered a cut on his forehead.

Hackman won the Academy Award for Best Actor for 1971's The French Connection and another Oscar for Best Supporting Actor in 1992's Unforgiven.

Werner Herzog talks "On Death Row" (Reuters)

LOS ANGELES, Jan 13 (TheWrap.com) ? Werner Herzog doesn't believe in the death penalty, but he's fond of the state that carries it out the most.

The German filmmaker behind such documentaries as "Grizzly Man" and "Cave of Forgotten Dreams" partly filmed his four-part Investigation Discovery series "On Death Row" in Texas. He said the state believes in the death penalty so strongly that it has nothing to hide, which allowed him great freedom to interview inmates.

"This kind of transparency has been very astonishing," he said. "Texas, by the way, is a state which I like. ... I like the heartland of America more than the fringes, which is California or, let's say Boston, or New York. ... and there has been something really special about Texas, the intensity of people."

Herzog spoke at the Television Critics Association winter press tour Friday.

Because prison guidelines required him to wrap up his interviews with death row inmates in just 50 minutes, Herzog had to quickly establish a tone with his subjects. The quick rapports didn't keep him from recognizing the horror of their crimes.

"James Barnes in my opinion is the ultimate nightmare for women," he said of an inmate he interviewed in Florida. "A man with the intention to murder you, and rape you, hides himself stark naked in your closet, and watches you for hours and hours, how you are doing your dinner, how you are watching a soap opera, how you take a shower, and keeps watching, watching, watching. And then comes out and murders you."

Try to imagine him saying it in that Herzog voice. Chilly.

Barnes was sentenced in 2007 in the attack Herzog described. Barnes killed Patricia Patsy Miller in 1988, and his DNA was matched to hers while he was serving a life sentence for the 1997 murder of his wife, Linda Barnes.

"On Death Row," the companion to Herzog's film "Into the Abyss," airs March 9.

MSI GT783 hands-on

A sub-three-pound laptop? Been there, done that -- at least if you're MSI. Three years after bringing netbooks and other cute things to CES, the company is focusing on more robust machines -- so much so that while other OEMs are launching me-too Ultrabooks, it's trotting out a gaming box instead. The latest addition to the family is the GT783, a 17-inch beast of a portable rig we saw while making the rounds at CES. Chief among the specs is NVIDIA's top-shelf GTX 580M GPU with 2GB of video memory, though your $2,300 will also buy you a quad-core Core i7 CPU, 16GB of RAM (upgradeable to 32GB) and a matte, 1080p display. Rounding out the list are dual drives: a 128GB SSD and 750GB 7,200RPM HDD. During our demo, we took a brief detour into Battlefield 3, and though we didn't have Fraps at the ready to monitor frame rates, we can tell you it ran smoothly, even at max settings. The programmable backlighting is alright too, though we're not convinced 35 colors will do it for you like a yellow chassis.

Kim Richards has left rehab, an insider confirms, although there are conflicting reports on how the reality star's time was spent inside the facility.

The Real Housewife of Beverly Hills - who checked in to an undisclosed facility in December - is "doing well," according to one Us Weekly source, but another claims she actually tried to leave at one point during her 30-day stay.

The 47-year-old was "very defiant," this mole says.

Kim Richards Crying

Any Real Housewives of Beverly Hills viewer could tell Kim was in need of help. She slurred her words at one point during season two and was told by co-star Dr. Paul Nassif that she abused prescription medicine.

What does Kim's future hold? It's too early to say. But it's not too early to guarantee that Bravo cameras will be there for whatever goes down next.

Twinkies maker Hostess seeks bankruptcy protection

(AP) ? Just like many Americans, the maker of Twinkies, Sno Balls and Wonder Bread is trying to lose the fat.

Hostess Brands is hoping to take a bite out of its high costs as it heads back into bankruptcy protection for the second time in less than a decade.

Hostess has enough cash to keep stores stocked with its Ding Dongs, Ho Hos and other snacks for now. But longer term, the 87-year-old company has a bigger problem: health-conscious Americans favor yogurt and energy bars over the dessert cakes and white bread they devoured 30 years ago.

Last year, 36 percent of Americans ate white bread in their homes, down from 54 percent in 2000, according to NPD Group. Meanwhile, about 54 percent ate wheat bread, up from 43 percent in 2000.

Consumption of healthy snacks is growing, too. About 32 percent of Americans ate yogurt at least once in two weeks in 2011, for instance, up from 18 percent in 2000.

"We're less likely to be snacking on items that we shouldn't be snacking on," said Harry Balzer, chief industry analyst for The NPD Group, a consumer marketing research firm.

Hostess, which is a privately held, doesn't disclose sales figures. But analysts say the iconic brand has been hurt by Americans' changing eating habits.

To be sure, Hostess' snacks don't neatly fit into the U.S. trend toward a healthier lifestyle that includes a diet rich in whole wheat foods, fruits and vegetables.

For instance, Twinkies, a snack cake with a mysterious cream filling that epitomizes empty calories, has 150 calories and 4.5 grams of fat. Meanwhile, a Ding Dong chocolate cake with filling has 368 calories and 19.4 grams of fat.

"The iconic status of Twinkies is partly this perception that there's nothing real in it," said Ken Albala, professor of history at the University of the Pacific, in Stockton, Calif., who specializes in food history. "It's this cake filled with an unidentifiable sugary cream filling that never goes bad."

Hostess has other problems, too.

In Hostess' Chapter 11 filing on Wednesday, the company said its rivals have combined and expanded their reach, heightening competition in the snack space. Hostess' competitors range from Bimbo Bakeries, which makes Entenmann's baked goods, and McKee Foods, which make Little Debbie snack cakes. It also faces competition from larger food makers like Sara Lee and Kraft Inc.

Additionally, Hostess employees are unionized while most of its competitors aren't. As a result, Hostess has high pension and medical benefit costs. The company has 19,000 employees and operates in 48 states.

Hostess did not announce layoffs but spokesman Lance Ignon said Wednesday that the company will make future decisions "in the best interest of the company."

CEO Brian Driscoll said the Hostess is working to reach a consensual agreement with its unions to modify its collective bargaining agreements. Hostess also hopes to modernize its systems, fleets and plants to keep pace with customer needs.

"This company has tremendous potential if we can remove the barriers to success," Driscoll said.

The Teamsters Union, which represents about 7,500 of Hostess' delivery drivers and merchandisers, said in a statement on Wednesday that it is also committed to working toward a solution.

The company's filing comes nearly three years after its predecessor emerged from bankruptcy proceedings. That company, called Interstate Bakeries and based in Kansas City, Mo., filed for bankruptcy protection in 2004 and changed its name to Hostess Brands after it emerged in 2009.

Hostess said Wednesday that its previous efforts to change, including the prior Chapter 11, were insufficient. Under its most recent bankruptcy filing, it is looking to restructure into a "strong, competitive" company.

In its filing with the U.S. Bankruptcy Court for the Southern District of New York, Hostess listed about $860 million in debt. The company's biggest unsecured creditor is the Bakery & Confectionary Union & Industry International Pension Fund, which it owes about $944.2 million.

In the filing, Hostess also listed its estimated assets between $500 million and $1 billion and its estimated liabilities at more than $1 billion.

The Irving, Texas-based company said that it will be able to maintain routine operations thanks to a $75 million financing commitment from a group of lenders led by Silver Point Capital LP.

(AP) ? A bomb targeting a militia opposed to the Pakistani Taliban exploded in a market close to the Afghan border Tuesday, killing 25 people in the deadliest blast in the country in several months, officials said.

The explosion, likely detonated by remote control, hit vehicles being used by the militia in the Khyber region, said local security officer Khan Dad Khan. It also wounded 24 people, said local government official Iqbal Khan.

Shopkeeper Sharif Gul said the blast ignited a huge fire.

"People were burning," he said at a hospital in Peshawar, the main town in the northwest. "There was nothing to put out the fire."

The army has supported the formation of anti-Taliban militias in northwest Pakistan, but the insurgents have ruthlessly attacked the groups over the last two years. Many of the country's bloodiest bombings have been against militia members or their families.

Islamist militants with links to al-Qaida have carried out hundreds of bombings in Pakistan since 2007, killing many hundreds of soldiers, police, government officials and civilians.

The Pakistani army has carried out offensives against the militants in their strongholds in tribally administered regions like Khyber, but the insurgents have proven to be a resilient foe. There have been conflicting reports of peace talks between some insurgent factions and the government in recent months.

While the frequency of large-scale attacks outside of the northwest has decreased over the last 18 months, the violence has triggered fears in the West that nuclear-armed Pakistan may be buckling under extremism.

The last major bombing was in September close to the Swat Valley, when a suicide bomber hit a funeral of a tribal elder opposed to the Taliban, killing 31 people.

Community college makeover

Until a few years ago, just about any Californian could attend a community college, and many did. The colleges offered a wide variety of options: They conferred two-year associate's degrees; prepared students for junior-year transfer to a four-year college; provided vocational training and certification; offered remedial courses for high school grads who lacked college skills; taught English to immigrants and enrichment courses to the elderly; offered recreational classes; provided college-level education ? and credits ? for ambitious high school students; and were the leading source of lifelong learning and career retraining for the state's adults.

But at this point, open access to higher education in California is more theoretical than real. Budget cuts have drastically reduced course offerings, making it extremely difficult for students to reach their educational goals. In 2009-10, nearly 140,000 entering students couldn't get into any classes because they had low priority in the registration system. Large numbers of students who are already attending community college are routinely shut out of courses they need to graduate or transfer. At the same time, other students meander through courses year after year, racking up far more credits than they need and taking up seats in classrooms. Many eventually drop out or never move out of the system at all. People who take courses for personal enrichment similarly fill classes that are needed by those aiming for degrees or specific training.

Bravo to the many Californians who value and seek out some form of higher education. But with the state no longer able to provide for all of them, a state task force is calling for sweeping changes. Some of the recommendations would use public dollars more efficiently while providing students fairer access. Others go too far, threatening to turn the colleges into certificate-production machines rather than true institutions of higher learning.

Make no mistake: Even if only the best of these proposals were adopted, the community colleges would be transformed in ways that would make them nearly unrecognizable to Californians who cherish the old something-for-everyone system. Top priority for course registration would go to students with a specific goal: a degree, transfer, career training or remedial help. Instead of registering online without guidance, most new students would have to attend mandatory orientation and counseling sessions to help them understand which classes they need to move through the system fluidly.

But once these students have 100 credits ? which translates to 25 to 30 courses, well over the 60 to 70 credits needed for a degree or transfer to a four-year school ? they would move to the bottom of the list for registration. Also given low priority would be people signing up for classes for personal enrichment and recreation. (One weakness in the plan: These people could easily game the system by indicating that their reason for taking a class is to retrain for a new career rather than enrichment.) Financially needy students who attend the colleges for free under fee waivers would have to start paying fees after earning 100 credits. Non-credit courses that have been free for senior citizens and low-cost recreational classes would largely disappear unless the colleges charged enough to make the classes self-sustaining.

These restrictions aren't something to celebrate. Ideally, community colleges could continue providing affordable, lifelong education for all Californians, but that's not realistic at the moment. It's fair and sensible to give lower priority in registration to students who have already taken more than their share of classes over the years, in order to provide seats to those who haven't had a chance. More painful, but still necessary, is reducing access for senior citizens and other adults. No one likes the idea of rationing education, but the reality is that access already is being rationed ? in unfair ways that harm entering students. This rationing would make the colleges more efficient, though only if they made good on the promise of orientation and counseling, so that students weren't aimlessly taking courses and never finding themselves eligible to graduate. And that would call for funding the colleges don't have right now.

Less helpful is the task force's relentless focus on moving students through the system as quickly as possible. It has outlined a community college experience that could be unfair to part-time students and that would have the unintended consequence of making college a less enriching experience. All students would be required to articulate a goal by the end of the first year of college, and a full educational plan by the end of the third semester. In addition, the state would target its funding of the colleges to discourage them from offering courses that aren't showing up in those educational plans.

Part-time students should not have to develop plans in just three semesters; they may have taken only three courses by then. Officials promise that there will be flexibility at the local level, but that flexibility must be incorporated into the task force report. The mandate for educational plans should be based on the number of credits taken, not on a point in time. The colleges hope to persuade more students to enroll full time, because such students have higher graduation rates. But pushing a student who needs to work into full-time studies could be counterproductive. Full-timers might be more successful not just because they take more courses but because of the financial resources that allow them to do so.

The recommendations also put too much emphasis on students taking only the courses within their defined plans, and on the colleges offering only those courses. A computer student who wants to take a literature course to deepen her education should be encouraged to do so, as long as she doesn't go beyond her allotted 100 credits. A philosophy student should feel welcome to delve into a biology course. Colleges don't just churn out degrees and certificates; they're supposed to encourage students to think big and try new things.

The community colleges can more efficiently educate California students through the 100-point rule and by giving top priority to students who need the education most, without reaching the point of becoming mechanistic.

Mexico goalkeeper arrested for helping kidnap gang

MONTERREY, Mexico - Mexico arrested former international soccer goalkeeper Omar Ortiz on suspicion of working for a gang of kidnappers, fanning concerns about lawlessness plaguing the United States' southern neighbor.

The 35-year-old Ortiz admitted helping to pick out two rich victims for the kidnappers, said Jorge Domene, government security spokesman for the northern state of Nuevo Leon.

The gang, who said they belonged to a drug cartel, sought an average of 1 million pesos ($73,000) per victim, of which Ortiz received a cut of more than 100,000 pesos, Nuevo Leon's government said.

"I'm speechless," said George W. Grayson, a Mexico expert at the College of William & Mary in Virginia, after the news of Ortiz's arrest. "I suppose it's an indication of the possible ubiquity of organized crime."

Sporting his trademark goatee beard, Ortiz looked impassive as masked soldiers paraded him and three other suspects in Nuevo Leon state capital Monterrey, a city that has increasingly come under attack by organized crime.

Domene said the gang operated by selecting victims at social gatherings, who were then snatched and ransomed.

Nuevo Leon attorney general Adrian de la Garza said the suspected kidnappers were captured on January 5 and noted that the gang's leader, who is still at large, told them they were working for the Gulf Cartel.

The conservative government of President Felipe Calderon has staked its reputation on rooting out Mexico's drug gangs, some of which have branched out extensively into other activities like robbery, extortion and kidnapping.

Ortiz's gang is suspected of over 20 kidnappings, among them the 2011 abduction of the husband of Mexican pop star Gloria Trevi, Domene said. Kidnapping is punishable by a jail term of up to 50 years, the state government noted.

After Ortiz disappeared earlier this week, Mexican media was awash with speculation he himself had been kidnapped.

The soccer star, who is currently serving a ban for a doping offence, only helped choose victims and provide information to the gang, whose suspected leader is still fugitive along with several others, Nuevo Leon said.

Between 2007 and 2010 kidnappings in Mexico leapt by nearly 200 percent from 438 to 1284, according to government data.

THE CAT

More than 46,000 people have been killed in the gang violence that has erupted since Calderon began his crackdown on drug cartels soon after taking office five years ago.

The war on the gangs is one of the main issues under debate in the Mexican presidential elections in July.

Drug gangs have long been suspected of corrupting public officials and politicians. Calderon's National Action Party (PAN) has sought to tar the main opposition Institutional Revolutionary Party (PRI) as susceptible to the cartels.

But public probes into sports stars and entertainers for suspected ties to organized crime have been rare.

Nuevo Leon attorney general Adrian de la Garza said there was no indication other soccer players were involved in the gang's kidnappings, which stretch back at least two years.

Nicknamed "El Gato" (The Cat) for his bright eyes, Ortiz played a single match for the Mexican national side in 2002.

In 2010, Ortiz was suspended after testing positive for anabolic steroids. That ban is due to expire in April.

Famous for his many tattoos and earrings, Ortiz was a longtime regular for top division side Monterrey.

Long seen as the jewel in the crown of Mexican industry, Monterrey has become mired in violence over the past two years as the Gulf Cartel has fought a bloody turf war with Los Zetas, a drug gang that once worked as enforcers for the cartel.

Murder, extortion and kidnapping have spread fear in the city of 4 million people that lies about 140 miles from the Texas border.

"This goes to show Monterrey is no longer this island of tranquility," said Grayson at William & Mary.

There?s a strange dynamic unfolding right now in Oakland, which probably shouldn?t come as much of a surprise to anyone who has followed the NFL for the last decade.? And there?s a theory making the rounds in league circles that the arrival of Reggie McKenzie as the team?s next General Manager could lead to the departure of coach Hue Jackson.

Even though both men are represented by Kennard McGuire, there are indications that Jackson wasn?t fully on board with the decision to hire McKenzie.? Jackson, whom we believe reports directly to owner Mark Davis, has been publicly candid (perhaps too candid) in recent days regarding his desire for more control.? It?s our understanding that, behind the scenes, Jackson has been even more candid, and that the arrival of McKenzie could ? not will but could ? result in Jackson being one and done in Oakland.

Would it be shocking?? Yes.? But not much more shocking than last year?s decision to part ways with Tom Cable after a far less expected 8-8 season.

Every G.M. wants to hire his own coach.? Even if the G.M. says as he walks through the door that he?s fine with the head coach who is in place, every G.M. wants to hire his own coach.? With Jackson seeming in recent days like a bit of a loose cannon when it comes to the management of the team, McKenzie could have some real misgivings about moving forward with Jackson.

The fact that McGuire represents both men will influence the situation, but that will go only so far.? At some point, McKenzie will have to make what he believes to be the right decision/recommendation for the franchise, even if it means potentially alienating his own agent by firing one of his agent?s other clients.

At this point, we?re not reporting that Jackson is on his way out or predicting that he?s not long for the job.? What we do know is that folks inside the league are keeping an eye on Oakland, because there?s a sense that McKenzie and Jackson possibly won?t be able to coexist.

India 351/8 at tea on Day 4 at the SCG

NEW DELHI: Australia took a 2-0 lead in the four-Test series by crushing India by an innings and 68 runs on the fourth day of the second Test at the Sydney Cricket Ground on Friday.

Scorecard

Ben Hilfenhaus took five wickets including the last scalp of R Ashwin (62) as India were bowled out for 400 runs in their second innings.

Australia were just one wicket away from an innings victory as Nathan Lyon trapped Ishant Sharma plumb in front of the wicket soon after R Ashwin's fifty.

Staring at an innings defeat, India were 351/8 in their second innings at tea.

India lost their eighth wicket when Peter Siddle had Zaheer Khan caught by Shaun Marsh, who took a fine tumbling catch over his head in the covers. Zaheer hit 35 from 26 balls with the help of a six and 5 fours.

India lost Sachin Tendulkar, VVS Laxman, captain MS Dhoni and Virat Kohli in quick succession.

James Pattinson got his first wicket when he trapped Kohli plumb in front of the wicket with a full straight delivery that Kohli tried to get across and flick but missed. The ball stayed low as well and hit him right in front.

Ben Hilfenhaus took his fourth wicket by dismissing Dhoni taking an easy return catch. Dhoni looked to drive the full delivery but hit it back without control. It lobbed up to Hilfenhaus who took it easily. It initially seemed as if it was a bump ball as Hilfenhaus did not celebrate, but the slip cordon came haring down in celebration. The on-field umpires referred to the third umpire and the replays showed that the ball came directly off the face of the bat towards the bowler.

Hilfenhaus dismissed Laxman with the second new ball that was pitched full just outside off and moved away just a touch. Laxman was squared up in defense and the ball went past the bat's edge to clip the off-stump leaving Laxman stunned.

Laxman hit 7 fours in his 66-run knock.

Tendulkar missed his 100th ton yet again as Australian captain Michael Clarke had him caught by Michael Hussey at first slip for 80.

Clarke tossed up a delivery outside off, Tendulkar came forward to defend but the ball spun away and took the outside edge, it went to Brad Haddin who was slow in getting up, but such was the luck for Tendulkar that the ball went off Haddin's gloves towards Hussey at first slip.

The moment Tendulkar's wicket fell there was stunned silence at the SCG and one could hear only Haddin and Hussey screaming in delight. Then the crowd gave the master a standing ovation as he departed for a wonderful 80.

Tendulkar hit 9 fours and added 104 runs with VVS Laxman for the fourth wicket.

India lost Gautam Gambhir in the first session.

Laxman scored a 92-ball 50 soon after lunch, which included six fours, to take India past the 250-run mark.

India, resumed at 114/2 on Friday, lost overnight batsman Gambhir (83) but scored 129 runs off 27 overs during the two-hour session.

Tendulkar hit a fighting half-century to lead India's battle alongwith VVS Laxman against the Aussies. Tendulkar's fifty came in 89 balls with the help of seven boundaries.

Earlier in the day, seamer Peter Siddle, who replaced Ben Hilfenhaus, gave Australia a crucial breakthrough as he got rid of Gambhir.

Gambhir, who scored 83 of 142 balls with the help of 11 fours, tried to play the shot on the on-side but it took the leading edge which was well caught by David Warner at point.

Gambhir and Tendulkar added 68 runs for the third wicket.

The conditions were little overcast on Day 4 due to some showers on Thursday evening but the weather is perfectly fine for the game of cricket at the SCG.

India, who have never won a Test series in Australia, reached third day stumps at 114 for two, 354 behind, with Gautam Gambhir on 68 and Sachin Tendulkar eight.

Earlier on the third day of the Test, Indian opener Virender Sehwag (4) and an uncertain Rahul Dravid (29) were cooling their heels in the pavilion, which raises the possibility of an innings defeat in the match.

Michael Hussey remained unbeaten on 150 but the glory of the day belonged to Australian skipper Michael Clarke who was left unconquered on 329, the highest score ever made at the SCG, which is hosting its 100th Test.

Triple centurion Michael Clarke put team interests ahead of personal glory as Australia moved towards a crushing win over India in the second Test.

Captain Clarke, unbeaten on 329, declared Australia's first innings closed at 659 for four to press for victory - despite various individual milestones beckoning.

After building a massive 468-run lead, Clarke called a halt to the onslaught to give his attack seven and a half sessions to bowl India out.

He was rewarded with the key wickets of Virender Sehwag and Rahul Dravid as the tourists dug in to save going 2-0 down in the four-Test series.

India had an early stumble when big-hitter Sehwag was brilliantly plucked from the air by the athletic David Warner at point off Ben Hilfenhaus for four.

Dravid's reputation as "The Wall" took another hit when he was out bowled for the third time in the series, this time by Hilfenhaus for 29.

Gambhir was lucky enough to survive after he was dropped by wicketkeeper Brad Haddin on 66 off James Pattinson in the penultimate over of the day.

Clarke's score is the fourth highest score by an Australian in Test cricket, behind Matthew Hayden (380), Sir Donald Bradman (334) and Mark Taylor (334).

This was the 25th instance of a triple century in Test cricket. Only Bradman, Brian Lara, Virender Sehwag and Chris Gayle are the four batsmen who have hit triple century twice in Tests.

Power Grab: Obama Recess Appoints Consumer Finance Czar ...

Obama?s new Consumer Financial Protection Bureau director is supposed to be confirmed by the Senate?not installed via recess appointment?

Yet here?s Ed Morrissey over at Hot Air sticking up for Obama:

National Journal reportsthat Obama will announce a recess appointment for Cordray to the Consumer Financial Protection Bureau ? and escalate the division between the Senate and the White House, and Democrats and Republicans:

President Obama will announce today that he will appoint Richard Cordray as head of the controversial Consumer Financial Protection Bureau during the Senate?s recess, the White House said.

The appointment comes to the dismay of Senate Republicans, who blocked Cordray?s nomination in order to weaken the bureau. ?

Obama is scheduled to make his first public appearance of 2012 on Wednesday at 1:15 p.m.?in the suburbs of Cleveland ? Cordray?s home state.

Of all the controversial appointments that the Senate GOP has managed to bottle up, this one had the weakest argument.? The objections of Republicans to Cordray rested mainly on the CFPB itself, not Cordray.? They had already forced Obama to withdraw his first nominee, Elizabeth Warren, who proved inartful at Congressional relations anyway.? The CFPB itself was a battle Republicans lost over a year ago.? Congress passed it into law, and Obama should be able to get a nominee to run it confirmed.? Republicans can win the next election and make the changes they wish in the next session, but it?s unreasonable to simply block the agency from operating with its chosen leadership.

They?ve been holding up the appointment until changes to the agency?s structure are made to provide oversight and accountability. I don?t think it?s unreasonable to insist on accountability.

Captitol Confidential at Big Government calls this an unconstitutional power grab:

Article II, Section 2 of the Constitution provides the president with the power to ?fill up all Vacancies that may happen during the Recess of the Senate.? The problem for the president and his liberal allies is that the Senate has not recessed and technically remains in session. However, liberal groups are pressing the White House to invoke the ?Roosevelt Option? to stack key government positions with radicals ready to carry out an anti-business, pro-big labor regulatory agenda. The Roosevelt Option is coined from the actions of Teddy Roosevelt who in 1903, in a split-second between two congressional sessions of Congress, made more than 100 recess appointments. In 2012, Congress will need to move from the First Session of this current Congress to the Second Session. Liberals claim the fraction of a second between the sessions is enough to trigger presidential power.

Others are more brazenly calling for the president to invoke presidential powers never before contemplated. Some have even suggested the president declare the Congress in recess, like a tinhorn dictator from a Third World country.

But even invoking the so-called ?Roosevelt Option? may not solve the liberals? conundrum. Sources tell Capitol Confidential that the statute creating the CFPB demands that the director be confirmed by the Senate?not installed via recess appointment?to trigger the agency?s shift from Treasury to the Fed and empower the Director.

But none of the legal or constitutional arguments may matter much. Liberals and the Obama administration appear poised to forge ahead with an outrageous and unconstitutional power grab. And by the time the courts work it out, so much damage will already be done.

Even RINO, Orrin Hatch is outraged:

?This is a very grave decision by this heavy-handed, autocratic White House. Circumventing the Senate and tossing out decades of precedent to appoint an unaccountable czar to appease its liberal base is beneath the office of the president,? Hatch said in a statement. ?The legislative branch exists as a check and a balance on the executive. By opening this door, the White House is saying it can appoint any person at any time to any position it chooses without the advice and consent of the Senate. This is not how our republic was designed to function.?

As The AP reported on New Years Eve: In 2012, Obama to press ahead without Congress:

The White House believes GOP lawmakers boxed themselves in during the pre-Christmas debate on the tax break and will be hard-pressed to back off their own assertions that it should continue through the end of 2012.

Once that debate is over, the White House says, Obama?s political fate will no longer be tied to Washington.

?Now that he?s sort of free from having to put out these fires, the president will have a larger playing field. If that includes Congress, all the better,? said Josh Earnest,White House deputy press secretary. But, he added, ?that?s no longer a requirement.?

Aides say the president will not turn his back on Congress completely in the new year. He is expected to once again push lawmakers to pass elements of his jobs bill that were blocked by Republicans last fall.

If those efforts fail, the White House says, Obama?s re-election year will focus almost exclusively on executive action.

Earnest said Obama will come out with at least two or three directives per week, continuing the ?We Can?t Wait? campaign the administration began this fall, and try to define Republicans in Congress as gridlocked and dysfunctional.

And Keith Koffler noted just the other day: Obama has officially abandoned governing:

In a startling interview with the New York Times, White House Deputy Press Secretary Josh Earnest all but acknowledged that Obama was finished with the presidency until he wins it again.

?In terms of the president?s relationship with Congress in 2012,? Mr. Earnest said at a briefing, ?the president is no longer tied to Washington, DC?

The president is no longer tied to Washington DC? Are Congress and Obama going to take their act on the road and make laws in Cincinnati? We?re finished legislating for the year?

?There are certainly other things the president would like to do,? Mr. Earnest said, citing other provisions of the?jobs bill. ?But in terms of essential, must-do items, the payroll tax cut extension is the last one.?

So, the economy is stalled, millions are out of work, and there are no more ?must do? items, other than the president?s reelection?

I have to give the White House credit for putting its card on the table. This is certainly a record-setting level of Chutzpah they are displaying. I called the Guinness Book of World Record, in fact, and they agreed to publish it immediately.

I don?t think now is a good time for Republicans to play dead. I want to see them fighting back.

Speaker Boehner weighs in on the appointment at his website:

It turns out that the action not only contradicts long-standing practice, but also the view of the administration itself. In 2010, Deputy Solicitor General Neal Katyal explained to the Supreme Courtthe Obama administration?s view that recess appointments are only permissible when Congress is in recess for more than three days. Here?s the exchange with Chief Justice John Roberts:

CHIEF JUSTICE ROBERTS: And the recess appointment power doesn?t work why?

MR. KATYAL: The ? the recess appointment power can work in ? in a recess. I think our office has opined the recess has to be longer than 3 days. And ? and so, it is potentially available to avert the future crisis that ? that could ? that could take place with respect to the board. If there are no other questions ?

CHIEF JUSTICE ROBERTS: Thank you, counsel.

Speaker Boehner called the appointment an ?extraordinary and entirely unprecedented power grab,? and noted that the position ?had not been filled for one reason: the agency it heads is bad for jobs and bad for the economy.?
