It?s official: Jurors in the John Edwards trial do not think they are deciding a simple case.
If all 12 of the North Carolinians judging the former U.S. senator thought it was clear Edwards broke the law when billionaire buddies Fred Baron and Rachel ?Bunny? Mellon supported his mistress and his former political-aide-turned-faux-father of the Edwards-Rielle Hunter baby, they would not be starting a seventh day of deliberations. And it is not just the duration of deliberations that suggests uncertainty; during nearly every courtroom entrance for the past week, jurors have worn furrowed brows and grim visages. They have made specific requests for dozen of exhibits and readily accepted the presiding judge?s offer to have every exhibit ? hundreds in all -- brought into the jury room.?

The FEC-DoJ split was highlighted in motions filed just before testimony ended. The defense requested the opportunity to play for the jury a tape recording of the FEC?s July 2011 audit hearing where it closed the books on John Edwards for President, Inc. despite the DoJ?s pending indictment of the candidate. The six FEC Commissioners voted unanimously in favor of closing the books after Commissioner Donald McGahn stated that ?I can say it. (The Mellon and Baron money) it?s ?? my view it?s not reportable (as a campaign contribution).?

Edwards also sought to introduce a 2009 Justice Department letter stating that, as a general rule, DoJ would only bring criminal charges in limited situations: ?The application of the law to the facts of a matter must at the very least be clear, and there must be no doubt that the (Federal Election) commission considers that the underlying conduct presents a FECA offense.?
Government attorneys opposed Edwards? motions and Judge Catherine Eagles ruled in prosecutors? favor.? Eagles also denied defense efforts to present two former FEC chairs prepared to testify that in their expert opinions, Edwards?s conduct did not rise to the level of a civil infraction, much less criminal wrongdoing.
Even without the former FEC chairs and the 2011 FEC audit hearing tape, the continuing deliberations are evidence that the ?application of the law to the facts? of the Edwards matter is not as far as the jury is concerned.? And because the arguments over what evidence would be admitted took place outside the jury?s presence, jurors don?t know what they don?t know about the FEC?s and DoJ?s varying views.?

Meanwhile, critics of the prosecution continue to suggest that if the federal government is going to throw the book at someone, particularly when the criminal statute at issue requires a ?knowing and willful? violation, it seems more fair to hit the person in the face rather than in the back of the head.?
Of course, the only view that matters is that of the jury. The verdict, and any descriptions jurors are willing to give on how they reached it, will offer a measure of finality (at least pending the outcome of an appeal if the decision is ?guilty?) if not clarity.

Leeches and lances might seem like prescriptions from the past. But bloodletting might be back in vogue. A small study shows that losing a little blood might improve cardiovascular health for obese people who also have what?s called metabolic syndrome.
The study tracked 33 patients with metabolic syndrome?defined by the presence of some of an assortment of conditions, such as high cholesterol, hypertension and insulin resistance. Researchers took 300 milliliters of blood from the patients, a little less than the one pint standard donation, with a repeat treatment a month later.
After six weeks, treated adults had lower blood pressure than the control group. Glucose levels also decreased, which suggests limited blood removal might improve metabolic health. The researchers think that the blood loss reduces iron levels. And excess iron in the blood has been tied to many metabolic syndrome ailments.
The FDA has okayed leeches for some procedures. Which could lead patients to thank their doctors for a treatment that sucks.

TOKYO (Reuters) - Hyped up market expectations of more forceful steps by Japan's central bank to beat deflation since its two-punch monetary easing has raised concerns it needs to temper the message, or risk leading investors up a blind alley.
The Bank of Japan eased monetary policy in February and set a 1 percent inflation target to show its determination to fix deflation that has plagued the country for more than a decade.
The aggressive steps, from out of the blue on Valentine's Day, succeeded in altering market perception of what the authorities would do and how they would do it.
But now, alarmed by what it sees as overblown expectations of frequent easing and worried about demands for more quantitative steps, the BOJ is carefully trying to tell markets that the large-scale stimulus measures in February and April were exceptional and won't be easily repeated.
The BOJ wants to signal a pause after easing monetary policy twice in just over two months, but without dispelling expectations it will act if the economy slips.
That is a tough balancing act with potential pitfalls and a big challenge for a central bank rarely praised for its skills in communicating with markets.
"The February easing created a misperception that monetary policy can solve everything. That needed to change," said a source familiar with the central bank's thinking. "A period of easing sporadically to beat deflation may be coming to an end."
Another source expressed a similar view. Both spoke on condition of anonymity due to the sensitivity of the matter.
With interest rates virtually at zero and markets awash with cash, the BOJ knows further easing may not have much direct impact on the economy. But it hopes its actions will lift sentiment, prompting companies and households to spend more.
The BOJ thus won't rule out another easing but wants to keep its finger firmly on the trigger, unless a Greek exit from the euro zone jolts financial markets or there is clear evidence that Japan's recovery is being derailed.
That is a different approach from the February and April actions, delivered despite growing economic momentum and justified as aimed at speeding up an exit from deflation.
In a sign of discomfort over the hyped-up expectations, minutes of the April meeting showed board members complaining about "misunderstanding" in markets that the central bank will ease automatically until 1 percent inflation was in sight regardless of what the economy was doing.
The BOJ presented itself as a bold deflation fighter by setting the inflation target and topping up its asset-buying program by 10 trillion yen ($126 billion), double the usual increment. It followed up with another increase of the same scale in April, bringing the target for asset purchases to 40 trillion yen.
Running out of ammunition, the BOJ now wants to pause.
But central bankers are apparently not quite sure how best to do this without disappointing markets and politicians growing impatient with the slow progress in ending deflation.
They got a taste of how tough it is to massage expectations when they removed from a policy statement last week a vow of pursuing "powerful" easing, in place since August 2010.
The move was meant to scale back expectations of frequent easing. It did just that, but a resulting yen rise led Governor Masaaki Shirakawa to stress that there was no change to the bank's powerful easing stance.
Mari Iwashita, chief market economist at SMBC Nikko Securities in Tokyo, questioned why the phrase was removed from the statement if Shirakawa had to revive it shortly after.
"The statement is an important tool for communication," she said. "This episode left some lessons for the BOJ on how it wants to communicate with the market."
TALK AND FORCE-FEEDING
The BOJ is walking a tightrope.
It needs to buy 20 trillion yen more of government bonds by June next year. But some of its bond-buying actions failed to draw enough bids this month as it struggles to force-feed funds to markets awash with cash, a sign it may not be able to top up the asset-buying program as frequently as before.
The central bank also worries that boosting bond buying too much without a clear government roadmap to get Japan's fiscal house in order may cause a jump in yields, a risk that led Fitch Ratings to cut the country's sovereign debt rating.
Shirakawa has thus stressed more than before that the BOJ is already buying huge amounts of bonds and with borrowing costs close to zero, there is little point in simply pumping money into markets. He has also warned that monetary stimulus cannot cure ills and only buys time for long-term structural reforms.
But the message has fallen on deaf ears to politicians who want bolder monetary support for the economy, particularly with Japan's huge debt pile leaving little room for fiscal stimulus.
Some lawmakers have called for extreme steps such as revising a law guaranteeing the BOJ's independence so that the government can tinker with monetary policy.
The government has dismissed such calls but wants the BOJ's support in shielding the export-reliant economy from the pain of any sharp yen rises as it tries to push through a sales tax increase to solve Japan's tattered finances.
That means a spike in the yen or jawboning by politicians will remain the key for any further easing, regardless of what line the BOJ wants to sell to markets, analysts say.
Atsushi Mizuno, a former BOJ board member and an executive at Credit Suisse
"Markets don't have time to read between the lines for subtle messages from the BOJ," he told Reuters this month.
"What markets want to hear is not what Shirakawa thinks is right but the BOJ's strong determination to beat deflation."

McCain won in 2008 against Obama, though only by 10 percent, 54 percent to 45 percent.

Comedian Joan Rivers is taking some heat for?two Whitney Houston jokes that reportedly appear in her upcoming book, "I Hate Everyone ... Starting With Me."
The Village Voice reports?that in a section on travel, Rivers writes: "I hate Houston ... it's crawling with bugs. Oh, wait, that's Whitney Houston; I'm sorry, my bad. (Can I just mention that Whitney looked fabulous at the Grammys?? She was in mahogany from head to toe.)"
Houston, 48,?was found dead in her Beverly Hills, Calif. hotel bathtub on Feb. 11, the day before the Grammys.
The jokes shouldn't be a surprise to those who read the book's description on?the website of publisher Penguin,?which reads, "uncensored and totally uninhibited (Rivers gives)?the best of her worst to First Ladies, closet cases, hypocrites, Hollywood, feminists,?and overrated?historical figures," and goes on to call the book an "honest, unabashedly hilarious love letter to the hater in all of us."
Readers of the Village Voice post were divided over whether Rivers' remark was too much, too soon.
"There's funny tasteless and there's just tasteless and unfortunately, this joke is in the latter category," wrote one reader.
Said another: "Joan Rivers is still funnier than most comedians half her age. Making tasteless jokes about celebrities is what she does. If you don't enjoy her, fine, but please don't try to say that all of a sudden she's crossed a line she never crossed before."
Back in February, in an interview with Andy Cohen on "Watch What Happens Live," Rivers said she's never regretted insulting anyone because her jokes are "never meant to be mean." She also said when singer Willie Nelson's daughter wrote her to say that a Rivers' joke about Nelson resulted in the girl being teased at school, she took that joke out of her act.
Also in February, Rivers was criticized by some for snarky remarks she made about Houston's wardrobe on the E! show "Fashion Police." According to Women's Wear Daily, Rivers said, "Am I sorry (Houston) died? Of course I am, for God?s sake." She also said "If Angelina Jolie died tomorrow, I would still say she was anorexic."
After Houston's death, Rivers tweeted, "Whitney Houston. What a sad tragedy ? the end of the life of an incredible talent. RIP to an amazing singer and legend.?
Rivers' book will be published June 5.

For pregnant women, folic acid is especially important as it can prevent major birth defects of the baby's brain or spine.

Folic acid may reduce some childhood cancers
Folic acid fortification of foods may reduce the incidence of the most common type of kidney cancer and a type of brain tumors in children, finds a new study by Kimberly J. Johnson, PhD, assistant professor at the Brown School at Washington University in St. Louis, and Amy Linabery, PhD, postdoctoral fellow at the University of Minnesota.
Incidence reductions were found for Wilms' tumor, a type of kidney cancer, and primitive neuroectodermal tumors (PNET), a type of brain cancer.Since 1998, the U.S. Food and Drug Administration has mandated fortification of foods with folic acid because earlier studies show that prenatal consumption of folic acid significantly reduces the incidence of neural tube defects in babies.

The study, published in the current issue of Pediatrics, examined the incidence of childhood cancer pre- and post-mandated folic acid fortification.
"We found that Wilms' tumor rates increased from 1986 to 1997 and decreased thereafter, which is an interesting finding since the downward change in the trend coincides exactly with folic acid fortification," Johnson says.
"PNET rates increased from 1986 to 1993 and decreased thereafter. This change in the trend does not coincide exactly with folic acid fortification, but does coincide nicely with the 1992 recommendation for women of childbearing age to consume 400 micrograms of folic acid daily."
Study authors used the 1986-2008 data from the National Cancer Institute's Surveillance, Epidemiology, and End Results Program (SEER), which has collected information on cancer cases in various areas of the U.S. since 1973. The study involved 8,829 children, from birth to age four, diagnosed with cancer.
"Declines in Wilms' tumors and PNETs in children were detected by multiple analyses of the data," Johnson says.
"Importantly, the reduced rates of Wilms' tumors also were found in a smaller study conducted in Ontario, Canada, that was published in 2011.
"More research is needed to confirm these results and to rule out any other explanations."
Julie A. Ross, PhD, professor and director of the Division of Pediatric Epidemiology & Clinical Research in the Department of Pediatrics at the University of Minnesota, was a study co-author.
Johnson notes that one concern countries face as they are deciding whether or not to fortify foods to reduce neural tube defects in newborns is the possibility that fortification may cause unintended harm, such as causing new cancers or pre-cancerous lesions.
"Here, we are showing that folic acid fortification does not appear to be increasing rates of childhood cancers, which is good news," she says.
